Terms and Conditions
1. Agreement to these Terms
These Terms and Conditions ("Terms") form a legally binding agreement between you ("you", "your", "Customer") and The Mate Company B.V., doing business as We Mate ("We Mate", "we", "us", "our"), a private company registered in the Netherlands with its registered office in Amsterdam.
These Terms govern your access to and use of the website https://wematedrink.com ("Website") and the purchase of any products offered through it ("Products"). By accessing the Website, placing an order, or otherwise using our services, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the Website or place orders.

A VAT number will be added to these Terms once registered with the Dutch tax authority (Belastingdienst).
3. Eligibility
To purchase Products on our Website, you must be at least 16 years of age. By placing an order, you confirm that you meet this age requirement. We reserve the right to refuse or cancel orders where age cannot be reasonably verified, given that our Products contain natural caffeine.
4. Account registration
Some features of the Website require you to create an account. You agree to provide accurate, current, and complete information during registration and to keep this information up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
You may not:
- Create accounts using false information or another person's identity
- Sell, transfer, or otherwise share your account or your "Founding 500" membership number with any third party
- Use the Website to advertise, solicit, or sell goods and services other than through legitimate ordering channels we provide
We reserve the right to suspend or terminate accounts that violate these Terms.
5. Products and availability
We Mate sells ready-to-drink yerba mate beverages in three flavours: Mint & Ginger, Citrus, and Mango & Passion Fruit. Products are sold in 330ml aluminium cans.
We make reasonable efforts to display Products and their characteristics accurately, but minor variations in colour, packaging, or batch can occur. Nutritional information, ingredients, and allergen information are provided on each can and on the relevant Product page. We are not responsible for typographical errors regarding pricing or descriptions and reserve the right to correct them.
Product availability is not guaranteed. If we cannot fulfil an order due to stock issues, we will inform you and offer either a full refund or an alternative Product.
6. Orders and contract formation
When you place an order through the Website, you make an offer to purchase the selected Products under these Terms. The contract between you and We Mate is formed only when we send you an order confirmation email. We may decline an order at our discretion, including (but not limited to) cases of suspected fraud, inability to verify payment, shipping restrictions to your location, or stock unavailability. If we decline, no charges will be made.
7. Pricing and payment
All prices are displayed in euros (EUR) and include VAT where applicable, unless otherwise stated. Shipping costs are calculated at checkout based on destination and order value.
We accept the following payment methods through our payment processor Stripe: Visa, Mastercard, American Express, iDEAL, and Bancontact. Payment must be completed at the time of placing the order. Card payments are processed securely by Stripe. We do not store full card details on our servers. By submitting payment, you authorise the charge of the total order amount to your selected payment method.
8. Founding 500 programme
The "Founding 500" is a limited pre-launch membership programme offering early access and discounts to the first 500 customers who register before our public launch in September/October 2026. Founding members receive benefits according to their tier: Founding 100 (25% off, welcome pack, early store access, name on the Wall of Founders, access to physical Mateadas in Amsterdam, limited-edition founder sticker); Founding 250 (20% off, welcome pack, early store access, name on the Wall of Founders, founder sticker); and Founding 500 (15% off, welcome pack, early access, early-community newsletter).
Founding 500 membership is personal and non-transferable. Selling, transferring, or sharing your Founding 500 number with third parties is prohibited and will result in revocation of membership without refund. We reserve the right to modify, suspend, or terminate the Founding 500 programme at any time, provided that benefits already accrued and paid for by existing members will be honoured.
9. Right to withdrawal (EU consumers)
If you are a consumer based in the European Union, you have the right under Directive 2011/83/EU to withdraw from your purchase contract within 14 days of receiving the Products, without giving any reason. The withdrawal period expires 14 days after the day you (or a third party indicated by you) acquired physical possession of the goods.
To exercise this right, you must inform us of your decision to withdraw by an unequivocal statement, sent to info@wematedrink.com, before the 14-day period expires. You may use a model withdrawal form, but it is not mandatory.
To meet the withdrawal deadline, it is sufficient that you send your communication concerning the exercise of the right to withdraw before the withdrawal period has expired.
Effects of withdrawal: if you withdraw from this contract, we will reimburse all payments received from you, including the costs of standard delivery (excluding any supplementary costs arising from your choice of a delivery type other than the least expensive standard delivery offered). Reimbursement will be made without undue delay and not later than 14 days from the day on which we are informed of your decision to withdraw, using the same payment method you used for the original transaction unless you have expressly agreed otherwise.
We may withhold reimbursement until we have received the goods back or you have supplied evidence of having returned them, whichever is the earliest. You are responsible for sending the goods back without undue delay and in any event no later than 14 days from the day on which you communicate your withdrawal.

10. Defective or incorrect products
If you receive a Product that is defective, damaged in transit, expired, or different from what you ordered, please contact us at info@wematedrink.com within 14 days of receipt with a description of the issue and (where possible) photographs. We will arrange a replacement or full refund at no cost to you, including any return shipping required.
This is in addition to your statutory rights as a consumer under EU and Dutch law, which include a legal guarantee of conformity for goods purchased.
11. Shipping and delivery
Shipping options, delivery times, and costs are detailed in our Shipping Policy. Estimated delivery times are indicative and not binding. We are not responsible for delays caused by carriers, customs processing, or events beyond our reasonable control.
Risk of loss and damage to Products passes to you upon delivery. If your shipment arrives visibly damaged, please document the damage upon receipt and contact us within 48 hours.
12. Acceptable use
You agree not to use the Website or our services to:
- Engage in any unlawful activity or violate any applicable laws or regulations
- Infringe our intellectual property rights or the rights of any third party
- Distribute viruses, malware, or any harmful code
- Attempt to gain unauthorised access to any part of the Website, our systems, or other users' accounts
- Use automated tools (bots, scrapers, crawlers) to access or copy content from the Website without our written consent
- Engage in fraudulent activity, including the use of stolen payment information
We reserve the right to investigate, suspend access to, and take legal action against any user violating these provisions.
13. Intellectual property
All content on the Website — including but not limited to the We Mate name, logo, trademarks, product designs, photographs, text, graphics, the Manifesto, and the overall look and feel — is the property of The Mate Company B.V. or its licensors and is protected by Dutch and international intellectual property laws.
You are granted a limited, non-exclusive, non-transferable licence to access and use the Website for personal, non-commercial purposes. You may not reproduce, modify, distribute, publicly display, sell, or create derivative works from any of our content without our prior written consent.
14. Privacy
Our handling of your personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Website, you acknowledge that you have read and understood our Privacy Policy. Our use of cookies and similar technologies is described in our Cookie Policy.
15. Limitation of liability
To the maximum extent permitted by applicable law, our total liability to you for any claim arising out of or relating to these Terms or your use of the Website or Products shall be limited to the amount you have paid to us for the Product giving rise to the claim.
Nothing in these Terms limits or excludes our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; (c) defective products under EU Directive 85/374/EEC (Product Liability Directive); or (d) any other liability that cannot be limited or excluded under applicable law.
16. Force majeure
We are not liable for any failure or delay in performing our obligations under these Terms when such failure or delay results from causes beyond our reasonable control, including but not limited to natural disasters, pandemics, acts of war or terrorism, government actions, supply chain disruptions, strikes, or carrier failures.
17. Changes to these Terms
We may update these Terms from time to time to reflect changes in law, our services, or business practices. The updated Terms will be posted on the Website with a revised "Last updated" date. For material changes, we will notify registered users by email (sent from noreply@wematedrink.com) at least 30 days before the changes take effect. Your continued use of the Website after the effective date constitutes acceptance of the updated Terms.
18. Governing law and jurisdiction
These Terms are governed by the laws of the Netherlands, without regard to conflict-of-laws principles. Any dispute arising out of or in connection with these Terms shall be resolved exclusively by the competent courts of Amsterdam, the Netherlands.
If you are an EU consumer, you may also use the European Commission's Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr. Nothing in this clause restricts your statutory rights to bring proceedings in your country of residence under EU consumer protection law.
19. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a competent court, that provision shall be modified to the minimum extent necessary or removed, and the remaining provisions shall continue in full force and effect.
